Legal Basement in North York — the short answer

A legal basement apartment — formally an Additional Residential Unit or second suite — is a self-contained dwelling in a basement that has been built to the Ontario Building Code, approved under a building permit, inspected, and where required registered with the municipality. Under Bill 23 (More Homes Built Faster Act), most detached, semi-detached and townhouse properties in Ontario may add one ARU as-of-right. In North York, that work is permitted and inspected through Toronto Building. Second suites are permitted as-of-right in most North York residential zones. Deep lots here often allow a rear walk-out rather than an excavated side entrance, which is both cheaper and produces a far better unit with real daylight.

What North York houses are like

Whether a North York basement can become a legal suite is decided by the house, not by the brochure. The older stock is post-war brick bungalow and split-level with deep lots that support walk-out grading. The newer stock is 3,000 to 5,000 square foot rebuilds from the 2000s onward, where the renovation question is almost always finish quality rather than structure. Willowdale in particular has been rebuilding lot by lot for two decades.

Lot grading in North York frequently drops toward the rear, which is the ideal condition for a walk-out basement suite. We check grade elevations at the feasibility stage because it can change a project's economics entirely.

Kitchen, bathroom, bedrooms, separate laundry, sound insulation, dedicated HVAC and ventilation, ESA inspection, final building inspection and municipal two-unit registration.
